Defective Roof Insulation

NMHC members are advised that they may be entitled to receive compensation pursuant to the settlement of a class action lawsuit (Sebago, Inc. et al. v. Beazer East, Inc.) involving Beazer phenolic foam roof insulation (Beazer PFRI). The plaintiffs in the class action alleged that Beazer PFRI, through the release of formic and sulfonic acids, had severely corroded and destroyed their metal roof decks and roofing systems. On December 13, 2000, a United States District Court in Massachusetts approved of a settlement, in which Beazer agreed to cover 100 percent of the costs associated with damage to metal roof decks caused by PFRI, and offered prorated settlements - on a square-foot basis - for roof replacements that are necessistated by the removal of PFRI. Subject to certain restrictions, NMHC members may be eligible for settlement class membership if they own, or are obligated to maintain, a roofing system that contained PFRI as of June 30, 2000. The deadline for filing a claim under the settlement is December 13, 2002.
