Lead-Based Paint Disclosure Requirements

In March 1996, EPA and HUD issued regulations implementing Section 1018 of the Residential Lead-Based Paint Hazard Reduction Act of 1992. 

The rule, which became effective later that year, require owners and managers of residential dwellings to provide buyers and lessees with a lead hazard information pamphlet (Protect Your Family ) and disclosure of any available information regarding lead-based paint at the property.

Before entering into sales contracts and leases, owners and lessors must require potential buyers or lessees to sign an acknowledgment of receipt of the disclosure forms, provide an opportunity to conduct paint inspections to prospective buyers and lessees, and maintain records documenting compliance with this rule. These requirements are collectively referred to as the "Disclosure Rule."
