Effective September 15, 2000 all pre-1978 properties receiving federal assistance must comply with new lead-based paint regulations. Generally, the more federal assistance a property receives, the stricter the requirements. NMHC/NAA have sought amendments to the regulation since it was released last year, contending that the rule: presents an unreasonable financial burden for owners; relies upon a largely nonexistent worker infrastructure; and would exacerbate the affordable housing shortage.

In late August, just before the rule was to go into effect, HUD conceded that more efforts were needed to ensure that the regulated community could comply with the regulations. On September 11, HUD published a transition strategy (65 FR 54858) addressing many of our objections and reducing the financial burden on housing providers.  This memo summarizes the specific changes made.
