The Environmental Protection Agency (EPA) continues its efforts to issue a proposed regulation to guide work practices during the renovation, repair, and painting of both public and commercial buildings.
Although the rules that are currently in place for pre-1978 properties, when lead paint was banned, have been focused on health assessments for children under six years old, the agency is seeking to expand them to include cardiovascular diseases in older adults. EPA has failed to rule out that apartment properties of five or more units would be considered commercial properties and there is also no cut off year for these buildings.
Compliance with the rule would be overly burdensome in light of the fact that the agency has yet to show the positive public health outcome that would be expected from expanding the regulations to encompass all public and commercial buildings.
EPA is fast-tracking the related proposed rule with one expected to be issued early next year. NMHC/NAA continue to object to the agency’s efforts without first doing the preliminary work required to ensure against an unnecessarily broad rule. We have joined with a coalition in hiring technical experts to analyze the proposed regulations and provide comments to the agency.
